1.2 Site Information Must Be Independently Verified

Dynamic Content may update automatically and may originate from third-party sources, public datasets, or automated scripts outside the control of DynamicEdge Realty.

DynamicEdge Realty does not warrant the accuracy, timeliness, availability, reliability, completeness, or suitability of any Dynamic Content, including information transmitted through Zoho CRM, Zoho Sites Dynamic Elements, IDX Broker, OneKey® MLS, MLS Grid, government databases, economic feeds, rate providers, calculators, or any third-party API. Dynamic Content may be delayed, incomplete, outdated, or contain errors, and all such information must be independently verified.

Dynamic Content is provided strictly for general informational and educational purposes only and does not constitute legal, financial, tax, engineering, appraisal, investment, or any other professional advice. Users are solely responsible for confirming the sufficiency, accuracy, and applicability of any Dynamic Content before relying upon it.

“User” means any person or entity that accesses or uses the Site in any manner, whether directly or through automated means.

3. Acceptable Use of the Site

You agree to use the Site only in accordance with these Terms and all applicable laws. You are responsible for your own actions when accessing or using the Site.

3.1 Permitted Personal Use

DynamicEdge Realty grants you a limited, revocable, non-exclusive license to access and use the Site for strictly personal, non-commercial purposes. For personal use only, you may:

copy, modify, distribute, transmit, display, perform, reproduce, or publish information from the Site;
download content for personal reference or educational purposes;
save real estate searches, favorite properties, or use consumer-facing tools provided by the Site;
use the features available through registered “VIP Access” or “Platinum Access” accounts as described in Section 3.7.

No rights are granted to you for commercial use, resale, redistribution, republication, or derivative use unless expressly authorized in writing by DynamicEdge Realty.

3.2 Prohibited Uses – No Commercial, Reproduction, or Derivative Use

You agree not to use the Site, or any portion of it, in any manner that is unlawful, unauthorized, or prohibited by these Terms. Without limitation, you may not:

modify, copy, distribute, transmit, display, perform, reproduce, or publish any material on the Site for commercial (non-personal) uses;
create derivative works from any Site content;
frame or embed Site content within another webpage;
use Site content on any other website or digital property;
transfer or sell any information, software, lists, databases, or compilations obtained from the Site;
use, reproduce, or repurpose any products, services, or proprietary tools provided by the Site.

This explicitly includes all curated content such as: Trusted Local Professionals directories, vendor lists, market research compilations, relocation resources, calculators, checklists, or custom-written guides.

3.3 Prohibited Uses – No Automated Access, Scraping, or AI Use

No scraping, data mining, harvesting, or bulk extraction of any data from the Site;
No use of bots, crawlers, spiders, scripts, or automation tools to access, monitor, or copy the Site;
No use of the Site, its data, or its structure to train AI or machine learning models (including large language models);
No creation of RSS feeds, automated “listening,” or continuous monitoring of Site changes without prior written permission from DynamicEdge Realty.

3.4 Prohibited Uses – No Circumvention of Security

You may not circumvent or attempt to circumvent authentication systems, password protection, or any security controls;
You may not access or attempt to access restricted, non-public, or password-protected areas of the Site without authorization;
Unauthorized access attempts may result in suspension, termination, and may be reported to law enforcement where appropriate.

3.5 Additional Restrictions Related to MLS & Vendor Data

As a condition of using this Site, you agree:

You will not copy, scrape, reproduce, or republish the Trusted Local Professionals / vendor directory or any curated vendor research;
You will not extract, scrape, or reproduce IDX, MLS, or OneKey® MLS data (including photos, remarks, or listing metrics);
You will not redistribute MLS content or use it for any derivative product or service.

3.6 Linking & Attribution Requirements

You may create links to DynamicEdgeRealty.com only if all of the following conditions are met:

The link must clearly attribute the destination as DynamicEdgeRealty.com;
You may not present the link in a way that suggests affiliation, sponsorship, or endorsement by DynamicEdge Realty;
You may not frame Site content or display it within another page, pop-up, or “framed” environment;
You must remove any link upon written request by DynamicEdge Realty, in its sole discretion;
No link may alter, distort, or obscure the appearance of DynamicEdgeRealty.com;
No link may be used in connection with false, defamatory, misleading, or harmful content.

3.7 Account Registration & Security (VIP Access & Platinum Access)

Certain features require registration, including VIP Access and Platinum Access (client-level) features. When you create an account, you agree to:

provide accurate, current, and complete information;
maintain the confidentiality of your password and account credentials;
accept responsibility for all activities that occur under your account;
promptly update your account information as needed to keep it accurate.

Depending on eligibility and status, account-level features may include, without limitation:

saved searches and unlimited property tracking using IDX tools;
AI-powered home search and market analysis tools;
Advanced Home Valuation by a Certified Pricing Strategy Advisor (PSA);
detailed home buying and home selling blueprints prepared by a Certified Buyer Representative (CBR) and Certified Seller Representative Specialist (SRS);
access to VIP Guides, PDF Library assets, and special pages;
access to certain affiliate offers, coupons, and discounts for Trusted Professionals;
for Platinum clients: CRM Portal access (including live updates on offers and transactions), enhanced AI / team support via Zoho Desk, and additional affiliate benefits.

DynamicEdge Realty may modify or discontinue any account-level feature at any time in its sole discretion.

3.8 Email Notifications

DynamicEdge Realty reserves the right, but not the obligation, to send electronic mail to Users of the Site, including:

registered Users, including VIP Access and Platinum Access Users;
Users who have submitted forms, inquiries, or support requests;
Users who need to be informed of material changes to the Site, services, or these Terms.

Some transactional or legally required emails (for example, security notices or critical changes to these Terms) may be sent even if you opt out of marketing communications. Optional marketing or promotional emails may be controlled through the unsubscribe options described in the Privacy Policy.

4. Information Provided to You Through the Site

The Site contains information originating from DynamicEdge Realty as well as information obtained from third parties, public sources, MLS data providers, and other contributors. You acknowledge and agree to the following:

THIS LIMITATION APPLIES EVEN IF DYNAMICEDGE REALTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

This includes, but is not limited to, mortgage estimates, affordability assessments, home valuations, tax estimates, planning scenarios, or market analytics.

8.3 No Liability for Decisions Based on Interactive Tools

IN NO EVENT SHALL DYNAMICEDGE REALTY BE LIABLE FOR ANY DECISION MADE OR ACTION TAKEN BY ANY USER IN RELIANCE UPON THE INFORMATION GENERATED BY ANY INTERACTIVE TOOL.

Your sole and exclusive remedy for dissatisfaction with an Interactive Tool is to stop using that tool and the Site.

8.4 Third-Party Data and APIs

Some Interactive Tools may incorporate data provided by third-party APIs, financial institutions, market data services, government databases, MLS/IDX providers, or other external sources. DynamicEdge Realty does not verify and cannot guarantee the accuracy of any external data.

Users are responsible for independently verifying all results.

8.5 No Offer to Lend or Extend Credit

NO INTERACTIVE TOOL, INCLUDING MORTGAGE OR FINANCIAL CALCULATORS, CONSTITUTES AN OFFER TO LEND, AN OFFER TO EXTEND CREDIT, OR ANY FORM OF PREQUALIFICATION OR PREAPPROVAL.

Interest rates, loan terms, and payment estimates shown within Interactive Tools are for demonstration purposes only.

9. Forums, User Submissions, and Responsibilities

From time to time, the Site may offer discussion forums, bulletin boards, blogs, chat areas, review features, communities, or other areas allowing Users to submit content (“Forums”). Your use of any Forum constitutes your agreement to comply with this Section and all other portions of these Terms.

9.1 User Responsibility for Submissions

You are solely responsible for any text, data, images, audio, video, reviews, comments, feedback, testimonials, files, or other materials you post, upload, transmit, or submit (“Submissions”). Submissions may be publicly visible and may be indexed by search engines. You should not include confidential, proprietary, or sensitive information.

9.2 Legal Rights & Permissions

By posting a Submission, you represent and warrant that:

You have all legal rights, licenses, permissions, and authority required to post the Submission.
Your Submission does not violate any law or infringe on the rights of any third party, including but not limited to copyrights, trademarks, patents, privacy rights, or publicity rights.
You have obtained consent from any individuals identifiable in any Submission.

9.3 Prohibited Content

You agree that you will not post, submit, or upload any Submission that, in the sole judgment of DynamicEdge Realty:

Is defamatory, libelous, harassing, threatening, abusive, hateful, discriminatory, unlawful, fraudulent, profane, sexually explicit, obscene, inappropriate, or indecent.
Harasses, stalks, threatens, or encourages harm toward any person or entity.
Contains or promotes surveys, contests, giveaways, pyramid schemes, multi-level marketing, chain letters, junk email, or any form of spamming.
Impersonates any person or entity, falsely states or misrepresents your identity, or creates a false identity to mislead others.
Contains malware, viruses, harmful code, or attempts to interfere with the Site’s technical operations.
Includes advertising, solicitations, promotions, or commercial messages without DynamicEdge Realty’s express written consent.

9.4 DynamicEdge Realty’s Rights Over Submissions

By posting any Submission to the Site, you grant DynamicEdge Realty, its subsidiaries, affiliates, partners, service providers, and third-party licensees a non-exclusive, perpetual, irrevocable, worldwide, transferable, sublicensable, royalty-free license to:

use, store, reproduce, display, publish, transmit, distribute, host, index, aggregate, adapt, edit, translate, and create derivative works from your Submission; and
store, publish or display your Submission, in whole or in part, on the Site or any related platform, now known or later developed.

This license shall apply to the distribution and the storage of your content in any form, medium, or technology now known or later developed. This license survives the termination of your account or your use of the Site.

9.5 DynamicEdge Realty’s Right to Monitor or Remove Content

DynamicEdge Realty may, but is not obligated to:

review, monitor, edit, refuse, or remove any Submission, at any time and for any reason;
restrict, suspend, or terminate a User’s ability to submit Submissions or use any Forum; or
disclose any Submission as required to comply with law, regulation, legal process, or to protect the rights, property, or safety of DynamicEdge Realty, its Users, or the public.

DYNAMICEDGE REALTY DISCLAIMS RESPONSIBILITY AND LIABILITY FOR THE CONTENT AND OPINIONS EXPRESSED BY USERS OR ANY THIRD PARTY ON THE SITE, INCLUDING BUT NOT LIMITED TO CONTENT OR OPINIONS REGARDING PRODUCTS OR SERVICES MENTIONED ON THE SITE.

9.6 User Indemnification for Submissions

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS DYNAMICEDGE REALTY FROM ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING OUT OF, RELATED TO, OR CONNECTED WITH YOUR SUBMISSIONS OR YOUR USE OF ANY FORUM.

9.7 Additional Forum Rules

Individual Forums may include additional rules, and you agree to comply with all such rules at all times. DynamicEdge Realty may remove Users from Forums or restrict Forum access at any time without notice.

10. Third-Party Services

The Site may provide access to, or information about, third-party services, including but not limited to mortgage lenders, financial tools, insurance providers, contractors, home service vendors, attorneys, title companies, and other commercial services (“Third-Party Services”). These services are offered solely as a convenience to Users.

10.1 No Endorsement or Warranty

DynamicEdge Realty does not endorse, recommend, supervise, warrant, or guarantee any Third-Party Service or any products, information, or services provided by such third parties. All third-party content is provided “as is,” and your interactions with third-party providers are entirely at your own risk.

10.2 Permission to Transmit User Information

To facilitate connections between you and Third-Party Service providers (including vendors identified in our Trusted Professionals directory), you authorize DynamicEdge Realty to disclose any information you voluntarily provide through the Site or our forms to such third-party providers that DynamicEdge Realty, in its sole discretion, deems relevant.

10.3 Your Responsibilities When Using Third-Party Services

You are solely responsible for:

ensuring all information you provide is true, complete, and accurate;
independently verifying all credentials, licensing, insurance, quality, reliability, reviews, and suitability of any Third-Party Service provider;
evaluating and agreeing to the third party’s own terms, conditions, privacy policy, fees, warranties, and service requirements;
conducting your own due diligence before engaging any provider; and
submitting requests for services only when you intend, in good faith, to contract with that provider if their services meet your needs.

10.4 No Liability for Third-Party Providers

DynamicEdge Realty is not responsible or liable for:

the performance, quality, acts, omissions, or services of any Third-Party Service provider;
any disputes between you and any third-party provider;
any injuries, losses, damages, delays, or expenses arising out of or relating to the actions or inactions of third parties; or
any insufficiency, inaccuracy, or incompleteness of a provider’s background, licensing, reputation, or capabilities.

10.5 Release of Claims

By using or contacting any Third-Party Service provider through the Site, you expressly release and forever discharge DynamicEdge Realty from any and all claims, demands, actions, losses, liabilities, damages, or disputes of any kind (known or unknown, suspected or unsuspected) arising from, related to, or connected with your interactions with such providers.

11. Testimonials, Endorsements & User Experiences

The Site may display testimonials, endorsements, reviews, success stories, ratings, comments, or other user-generated feedback (“Testimonials”). All such content is subject to the following terms.

11.1 True Consumer Opinions — Not Professional Advice

Testimonials reflect the real-life opinions or experiences of past clients or users of DynamicEdge Realty’s services. They are provided strictly for general informational and educational purposes and are not professional advice, performance guarantees, predictive statements, or typical results.

11.2 No Guarantees of Future Results

Individual results vary. Outcomes depend on market conditions, the condition of a property, the buyer/seller, lender requirements, negotiation circumstances, and many other factors outside the control of DynamicEdge Realty. Testimonials do not guarantee or predict your results.

11.3 Compensation and Affiliate Disclosure

Testimonial providers are not compensated for their statements. If an individual providing a testimonial also participates in an affiliate program or receives any form of consideration, such relationship will be clearly disclosed in compliance with FTC 16 C.F.R. Part 255.

11.4 Editing and Presentation

Testimonials may be lightly edited for:

clarity, grammar, or length;
protecting private or confidential information;
removing sensitive, regulated, or inappropriate content.

However, the substance of each testimonial remains materially true to the provider’s original statement.

11.5 No Responsibility for User Opinions

DynamicEdge Realty DISCLAIMS ALL RESPONSIBILITY AND LIABILITY FOR THE CONTENT, ACCURACY, OR OPINIONS EXPRESSED BY USERS, CLIENTS, OR THIRD PARTIES IN ANY TESTIMONIALS, REVIEWS, OR ENDORSEMENTS. These statements do not reflect the views of DynamicEdge Realty and should not be interpreted as such.

11.6 Ownership, License & Use of Submitted Testimonials

By submitting a testimonial (including written, audio, video, social media, email, text, or other formats), you grant DynamicEdge Realty and its subsidiaries, affiliates, partners, and third-party licensees a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, sublicensable license to:

use, store, display, publish, reproduce, and distribute the testimonial;
create derivative works; and
transmit and publicly perform the testimonial in any form, medium, or technology now known or later developed.

This license applies equally to the distribution and storage of your testimonial across all marketing channels, including but not limited to websites, printed materials, social media, advertisements, and internal databases.

11.7 Submission Requirements

Users warrant that all submitted Testimonials:

are truthful and based on genuine experiences;
do not violate copyright, trademark, patent, privacy, publicity, or other third-party rights;
are not defamatory, obscene, harassing, libelous, hateful, unlawful, or inappropriate;
are not created using AI tools without clear disclosure;
do not impersonate another person or create a false identity; and
do not include prohibited content (e.g., spam, chain letters, pyramid schemes, commercial solicitations).

11.8 Right to Remove or Modify Testimonials

DynamicEdge Realty may edit, remove, refuse to display, or disable access to any testimonial or user-submitted content at any time and for any reason, including for legal compliance or accuracy concerns.

11.9 Compliance with FTC Guidelines and Applicable Law

All testimonials featured on the Site have been used in accordance with applicable law, comply with the Federal Trade Commission’s endorsement and advertising guidelines, and respect the privacy of our customers, users, and endorsers. See 16 C.F.R. Part 255.

12. Advertisers

The Site may display advertisements, promotional banners, sponsored links, affiliate offers, or other forms of paid or unpaid advertising (“Advertisements”). Such Advertisements may be provided by third parties over whom DynamicEdge Realty has no control.

12.1 No Endorsement or Warranty

The presence of an advertisement on the Site does not constitute an endorsement, approval, recommendation, or sponsorship by DynamicEdge Realty unless expressly stated in writing. DynamicEdge Realty makes no representation or warranty regarding:

the accuracy of any claims made by advertisers,
the quality, safety, legality, or fitness of any advertised products or services,
the truthfulness or completeness of any advertiser statements,
the performance of any advertiser or affiliated business.

12.2 Not Responsible for Advertiser Products or Services

DynamicEdge Realty is not responsible for the products or services of any advertiser appearing on the Site. You are solely responsible for evaluating these products or services and for verifying any claims directly with the advertiser.

12.3 No Liability for Advertiser Conduct

DynamicEdge Realty shall not be liable for:

any loss, damage, injury, or claim arising from your dealings with advertisers;
the actions, omissions, or representations of advertisers;
any dispute between you and an advertiser.

12.4 Independent Investigation Required

Before purchasing or engaging with any product or service offered by an advertiser, you agree to conduct your own independent research and due diligence. Advertisements may carry their own terms, conditions, and privacy policies that differ from those of DynamicEdge Realty.

12.5 FTC Compliance

DynamicEdge Realty complies with all applicable advertising and disclosure laws, including the Federal Trade Commission’s rules regarding advertising, endorsements, and affiliate relationships.

13. Modification of Agreement

DynamicEdge Realty reserves the right, in its sole discretion, to modify, amend, update, or remove any part of these Terms at any time, with or without prior notice. Any such modification becomes effective immediately upon being posted on the Site, unless a later effective date is expressly stated.

Your continued use of the Site following any modification of these Terms constitutes your conclusive acceptance of the revised Terms. If you do not agree to any updated Terms, you must discontinue using the Site immediately.

DynamicEdge Realty may also update or modify portions of the Site, including features, functionality, tools, data sources, calculators, or content, at any time and without notice. Such changes may affect how you access or use the Site, and DynamicEdge Realty shall not be liable for any resulting impact.

Users are responsible for reviewing these Terms regularly to remain informed of any updates.

14. Suspension or Termination of Access

DynamicEdge Realty may, in its sole discretion, at any time and without prior notice, suspend, restrict, or terminate any User’s access to the Site, any portion of the Site, or any services offered through the Site, for any reason or no reason, including but not limited to:

any violation of these Terms or any referenced policies or disclosures;
conduct that DynamicEdge Realty determines, in its sole judgment, to be unlawful, inappropriate, disruptive, harmful, deceptive, abusive, or inconsistent with the operation, security, or integrity of the Site;
attempts to access protected, secure, or non-public areas of the Site without authorization;
misuse of tools, calculators, MLS/IDX data, or account credentials;
use of automated agents, bots, crawlers, scrapers, AI model-training, or any prohibited automated access methods;
fraudulent, misleading, or bad-faith submissions or inquiries;
any activity affecting system performance, security, or the experience of other Users.

DynamicEdge Realty may also, at any time and without notice, modify, suspend, or discontinue any feature, tool, calculator, content source, MLS data feed, vendor directory component, or other part of the Site, temporarily or permanently. DynamicEdge Realty shall have no liability to any User or third party for any such modification, suspension, or discontinuation.

If your access is terminated, you agree that you will not attempt to regain access using a different identity, registration, or technical method without the express written permission of DynamicEdge Realty.

Termination or suspension does not limit DynamicEdge Realty’s right to seek all remedies available under law or equity, nor does it relieve Users of any ongoing obligations that by their nature survive termination, including but not limited to: intellectual property restrictions, indemnification provisions, disclaimers, and limitations of liability.

15. Indemnification

BY USING THIS SITE, YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS DYNAMICEDGE REALTY, ITS OWNERS, OFFICERS, BROKER, AGENTS, EMPLOYEES, SUBSIDIARIES, PARTNERS, AFFILIATES, SERVICE PROVIDERS, SUPPLIERS, AND SUCCESSORS, FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, LIABILITIES, LOSSES, DAMAGES, COSTS, AND EXPENSES (INCLUDING BUT NOT LIMITED TO REASONABLE ATTORNEY’S FEES) ARISING OUT OF OR RELATED TO:

YOUR VIOLATION OF ANY TERM OF THESE TERMS OF USE OR ANY REFERENCED POLICY OR DISCLOSURE;
YOUR USE OR MISUSE OF THE SITE, INCLUDING ANY TOOLS, CALCULATORS, VENDOR LISTINGS, RELOCATION RESOURCES, OR MLS/IDX DATA;
ANY CONTENT, MATERIAL, OR INFORMATION YOU SUBMIT, TRANSMIT, OR OTHERWISE MAKE AVAILABLE THROUGH THE SITE;
YOUR INTERACTION OR DEALINGS WITH THIRD-PARTY SERVICE PROVIDERS, INCLUDING VENDORS AND AFFILIATES;
YOUR INFRINGEMENT OR MISAPPROPRIATION OF ANY COPYRIGHT, TRADEMARK, OR OTHER INTELLECTUAL PROPERTY OR PROPRIETARY RIGHT;
ANY ACTUAL OR ALLEGED ILLEGAL, NEGLIGENT, OR UNAUTHORIZED USE OF THE SITE BY YOU.

THIS INDEMNIFICATION OBLIGATION SHALL SURVIVE YOUR USE OF THE SITE, ANY TERMINATION OF ACCESS, AND ANY TERMINATION OF THESE TERMS.

16. GENERAL TERMS

16.1 These Terms constitute the entire understanding and agreement between you, the User, and DynamicEdge Realty, and supersede any and all prior or contemporaneous agreements, representations, warranties, negotiations, or understandings, whether written or oral, relating to the subject matter herein. All such prior agreements are merged into these Terms.

16.2 These Terms are binding upon DynamicEdge Realty and you, the User, and their respective heirs, successors, legal representatives, and permitted assigns. These Terms are not assignable by the User without the prior written consent of DynamicEdge Realty. Any attempted assignment in violation of this clause is void.

16.3 If any provision of these Terms, or its application, is held to be invalid, illegal, or unenforceable in any respect by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect and interpreted so as to best give effect to the original intent of the parties.

16.4 Headings, section titles, and capitalization conventions are provided solely for organizational convenience and shall not affect the interpretation of these Terms. Reading any specific section does not absolve the User from the obligation to read and comply with all provisions and all incorporated policies. Words importing the singular include the plural and vice versa, and words importing any gender shall include all genders, as required by the context.

16.5 No provision of these Terms, nor any statement on the Site, is intended to create or imply any contractual relationship between the User and OneKey® MLS or any REALTOR® association. OneKey® MLS and any REALTOR® associations have not reviewed, approved, endorsed, or participated in the drafting of these Terms, nor do they have any responsibility for compensation or any other provision contained herein.

16.6 These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of New York, United States of America, without regard to its conflict-of-law rules. The User hereby consents to the exclusive jurisdiction and venue of courts sitting in New York, County of Nassau, and/or the Eastern District of New York, in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this paragraph.

16.7 A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent, and subject to the same conditions, as other business documents and records originally generated and maintained in printed form.

16.8 THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES PUBLISHED ON THIS SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. DYNAMICEDGE REALTY AND ITS AFFILIATES AND/OR ITS RESPECTIVE SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THIS SITE AT ANY TIME.

IN NO EVENT SHALL DYNAMICEDGE REALTY AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, GOODWILL, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF DYNAMICEDGE REALTY OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

16.9 All materials on the Site (including the organization and layout of the Site) are owned and copyrighted or licensed by DynamicEdge Realty, its affiliates, suppliers, or licensors. No reproduction, distribution, or transmission of the copyrighted materials on the Site is permitted without the written permission of DynamicEdge Realty. Any rights not expressly granted herein are reserved. These Terms expressly incorporate and include the disclaimer appearing in the footer of the Site.

17. DMCA NOTICE — COPYRIGHT INFRINGEMENT CLAIMS

DynamicEdge Realty respects the intellectual property rights of others and expects all Users of the Site to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. §512, DynamicEdge Realty will respond to properly submitted notices of alleged copyright infringement relating to material posted on or through the Site.

IF YOU BELIEVE THAT YOUR COPYRIGHTED WORK HAS BEEN COPIED, POSTED, DISTRIBUTED, DISPLAYED, OR OTHERWISE USED ON THE SITE IN A WAY THAT CONSTITUTES COPYRIGHT INFRINGEMENT, YOU MUST PROVIDE A WRITTEN DMCA TAKEDOWN NOTICE THAT INCLUDES THE FOLLOWING:

A description of the copyrighted work or other intellectual property that you claim has been infringed;
A description of where the material that you claim is infringing is located on the Site;
An address, a telephone number, and an email address where DynamicEdge Realty can contact you and, if different, an email address where the alleged infringing party, if not DynamicEdge Realty, can contact you;
A statement that you have a good-faith belief that the use is not authorized by the copyright or other intellectual property rights owner, by its agent, or by law;
A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner’s behalf; and
Your electronic or physical signature.

DynamicEdge Realty may request additional information before removing any infringing material. DynamicEdge Realty may provide the alleged infringing party with your email address so that that person can respond to your allegations.

18. USER’S CONSENT TO BE LEGALLY BOUND
